These terms form a contract between you and the operator of SeekInflu, identified on the Operator Information page. Please read them before subscribing. SeekInflu is an independent third-party service: it is not YouTube, it is not operated by Google, and neither company endorses it.
What SeekInflu does
SeekInflu searches the YouTube Data API for videos related to a product, service or topic you describe, groups the results by channel, and reports which of those channels have uploaded recently. Results are presented as "channels with videos related to your search".
SeekInflu makes no claim about any creator’s suitability, quality, audience or willingness to work with you, and assigns no score to any person. It sells access to its own software only: it does not pay creators, does not broker or manage deals between you and any creator, does not send messages on your behalf, and is not a marketplace or an advertising agency.
Eligibility and your account
You must be at least 18 years old and able to enter into a binding contract. If you register on behalf of an organisation, you confirm you are authorised to bind it, and "you" means that organisation.
You must provide accurate registration details and keep your credentials secure. You are responsible for everything done under your account. One account is for one organisation or individual; sharing credentials across teams is not permitted. Tell us promptly if you believe your account has been compromised.
Acceptable use
You agree not to:
- Use SeekInflu to profile individuals by religion, political affiliation, sexual orientation, health status, ethnicity or any other protected attribute. Such searches are refused by the service.
- Attempt to obtain, infer or reconstruct contact details that SeekInflu deliberately does not provide.
- Resell, redistribute, publish or systematically export SeekInflu results as a standalone dataset, or use them to train a machine-learning model.
- Circumvent plan limits, rate limits, authentication or any technical restriction, or access the service other than through the interface we provide.
- Use the service to harass creators, or to send unsolicited bulk messages in breach of applicable law, including the Japanese Act on Regulation of Transmission of Specified Electronic Mail.
- Use the service unlawfully, infringe anyone’s rights, or interfere with the operation or security of the service.
YouTube API Services
SeekInflu is an API Client of YouTube API Services. By using SeekInflu, you also agree to be bound by the YouTube Terms of Service at https://www.youtube.com/t/terms. How Google handles personal data in this context is described in the Google Privacy Policy at https://www.google.com/policies/privacy/, and you can revoke SeekInflu’s access to your Google account at https://security.google.com/settings/security/permissions.
All YouTube content and data shown in SeekInflu belongs to its respective owners and remains subject to YouTube’s own terms. "YouTube" and related marks are trademarks of Google LLC; SeekInflu claims no rights in them and uses them only to identify the source of the data.
Google may change, limit or withdraw API access at any time. If that happens, some or all features may stop working through no fault of ours. If it makes the service permanently unusable, we will cancel affected subscriptions and refund the unused portion of any period already paid for.
Plans, billing and taxes
Prices are shown on the pricing page in US dollars and exclude any applicable tax, which is calculated and added at checkout. Paid plans are billed in advance, either monthly or yearly according to the plan you choose, through our payment provider.
Subscriptions renew automatically at the end of each billing period at the then-current price for your plan, until you cancel. Monthly allowances reset on the first day of each calendar month (UTC) and do not roll over. Unused allowance has no cash value.
If a payment fails we may retry it and may suspend paid features until it succeeds. Enterprise terms, including volume, invoicing and payment method, are agreed separately in writing and prevail over this section to the extent they differ.
Price changes
We may change prices. We will give you at least 30 days’ notice by email before a change takes effect for your subscription, and the new price applies from your next renewal. If you do not accept it, you may cancel before that renewal and the change will not be charged to you.
Cancellation and refunds
You can cancel at any time from your account page. Cancellation stops the next renewal; your plan stays active until the end of the period you have already paid for, and your data remains available until then.
Because access is granted immediately on payment, we do not offer pro-rated refunds for a partial period, and there is no statutory cooling-off period for this type of online service under Japanese law. This does not affect any refund we owe you under mandatory law, nor the refund described in the YouTube API Services section above.
If the service is unavailable for an extended period through our fault, contact us: we will discuss a credit or refund in proportion to the outage.
Availability
SeekInflu depends on the YouTube Data API, which imposes a daily quota shared across all users of the service. When that quota is exhausted, searches already cached continue to work and new searches are temporarily unavailable; you are told so explicitly rather than shown an error. Searches refused for this reason are not counted against your allowance.
We aim for high availability and may perform maintenance, ordinarily with notice. We do not offer a service-level guarantee on self-serve plans. Enterprise agreements may include one.
Intellectual property
The SeekInflu software, interface, branding and documentation belong to the operator. Your subscription grants you a limited, non-exclusive, non-transferable right to use the service while it is active, and nothing more. You may not copy, modify, decompile or create derivative works from it except to the extent the law forbids that restriction.
The notes you write and the lists you build remain yours. You grant us only the licence needed to store and display them back to you in the course of running the service.
You may use search results and CSV exports freely inside your own organisation, including in reports to your clients. What you may not do is publish or sell them as a dataset in their own right — see Acceptable use.
Suspension and termination
We may suspend or terminate your account if you materially breach these terms, if your use threatens the security or lawful operation of the service, if payment fails and remains unresolved, or if we are legally required to. Where the circumstances allow, we will warn you first and give you a chance to put it right.
If we terminate without cause, we will refund the unused portion of the period you have paid for. You may close your account at any time; see the Privacy Policy for what is deleted and what we must keep.
Disclaimer
SeekInflu is provided "as is" and "as available". Data originates from third-party APIs and may be incomplete, delayed, inaccurate or withdrawn. We do not warrant that results are exhaustive, that any channel identified is a suitable partner, or that any outreach based on the results will succeed. Decisions you take on the basis of the service are yours.
Limitation of liability
To the maximum extent permitted by law, our aggregate liability arising out of or relating to the service is limited to the fees you paid in the three months preceding the event giving rise to the claim, and we are not liable for lost profits, lost business or indirect or consequential loss.
Nothing in these terms limits liability that cannot be limited by law. In particular, this cap does not apply to damage caused by our intent or gross negligence, to death or personal injury, or — where you are a consumer — to any liability that the Japanese Consumer Contract Act or equivalent mandatory law does not permit us to exclude.
Indemnity
If you are not a consumer, you agree to indemnify us against third-party claims arising from your use of the service in breach of these terms or of applicable law, including how you contact or treat the creators you find.
Events outside our control
Neither party is liable for failure to perform caused by an event beyond its reasonable control, including a change to or outage of the YouTube Data API, a failure of our hosting or payment providers, a network failure, a natural disaster, or an act of government. This does not excuse an obligation to pay amounts already due, or our obligation to refund a period you paid for but cannot use.
Changes to these terms
We may update these terms. Material changes will be announced in the product or by email at least 30 days before they take effect. Continuing to use SeekInflu after that date constitutes acceptance; if you would rather not accept, cancel before it.
General
If a provision is held unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. You may not assign this contract without our consent; we may assign it to a successor of the business, on notice to you. These terms, together with the Privacy Policy and the Operator Information page, are the entire agreement between us about the service.
These terms are published in English and Japanese. Where the two differ, the English text governs, except where mandatory law requires otherwise.
Governing law, disputes and complaints
These terms are governed by the laws of Japan. The Tokyo District Court has exclusive jurisdiction as the court of first instance over any dispute arising from them.
If you are a consumer, this does not deprive you of the protection of mandatory rules of the country where you live, including any right to bring proceedings in your local courts.
Before going to court, please raise the problem with us. Write to the contact address on the Operator Information page describing what happened and what outcome you want. We acknowledge complaints within 7 days and aim to resolve them within 30 days. Most problems are quicker to fix than to litigate.
